General information about the legal bases for data processing on this website

If you have consented to the data processing, we process your personal data based on Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR, provided that special categories of data are processed under Art. 9(1) GDPR. In the event of explicit consent to the transfer of personal data to third countries, data processing also takes place on the basis of Art. 49(1)(a) GDPR. If you have consented to the storage of cookies or to access information on your end device (e.g., via device fingerprinting), data processing also takes place on the basis of § 25(1) TDDDG. Consent can be withdrawn at any time. If your data is required for contract performance or for the implementation of pre-contractual measures, we process your data on the basis of Art. 6(1)(b) GDPR. Furthermore, we process your data insofar as it is necessary to fulfill a legal obligation pursuant to Art. 6(1)(c) GDPR. The data processing may also take place on the basis of our legitimate interest pursuant to Art. 6(1)(f) GDPR. The relevant legal bases in each individual case are explained in the following paragraphs of this privacy policy.

Information about data transfer to third countries that are not data protection-compliant and about the transfer to US companies that are not DPF-certified

Among other things, we use tools from companies based in third countries that are not legally secure for data protection purposes, as well as US tools whose providers are not certified under the EU-US Data Privacy Framework (DPF). When these tools are active, your personal data may be transferred to and processed in these countries. We point out that no level of data protection comparable to that of the EU can be guaranteed in datally unsafe third countries.

We point out that the USA, as a safe third country, generally has a data protection level comparable to that of the EU. Data transmission to the USA is permissible if the recipient holds a certification under the „EU-US Data Privacy Framework“ (DPF) or has appropriate additional guarantees. Information on transfers to third countries, including the data recipients, can be found in this privacy policy.

Recipients of personal data

As part of our business activities, we work with various external parties. In some cases, the transmission of personal data to these external parties is also required. We only pass on personal data to external parties if this is necessary as part of fulfilling a contract, if we are legally obliged to do so (e.g., the disclosure of data to tax authorities), if we have a legitimate interest in the disclosure pursuant to Art. 6(1)(f) GDPR, or if another legal basis allows the data transfer. When using contract processors, we only pass on personal data of our customers on the basis of a valid contract for contract processing. In the case of joint processing, a contract for joint processing is concluded.

Revocation of your consent to data processing

Many data processing operations are only possible with your express consent. You can revoke an already given consent at any time. The legality of data processing carried out up to the revocation remains unaffected by the revocation.

Right of objection to data collection in special cases as well as to direct advertising (Art. 21 GDPR)

IF THE DATA PROCESSING IS CARRIED OUT ON THE BASIS OF ARTICLE 6(1)(E) OR F OF THE GDPR, YOU HAVE AT ANY TIME THE RIGHT TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. FOR EACH LEGAL BASIS ON WHICH PROCESSING IS BASED, YOU SHOULD CONSULT THIS DATA PROTECTION NOTICE. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR PERSONAL DATA, EXCEPT WHERE WE CAN PROVE MANDATORY PROHIBITIVE GROUNDS FOR THE PROCESSING, WHICH OUTWEIGH YOUR INTERESTS, RIGHTS AND FREEDOMS OR WHERE THE PROCESSING IS NECESSARY FOR THE ASSERTION, EXERCISE OR DEFENSE OF LEGAL CLAIMS (OBJECTION PURSUANT TO ARTICLE 21(1) OF THE GDPR).

IF YOUR PERSONAL DATA ARE BEING PROCESSED TO CONDUCT DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF YOUR PERSONAL DATA FOR SUCH MARKETING; THIS ALSO APPLIES TO PROFILING, WHICH IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL NO LONGER BE USED FOR THE PURPOSE OF SUCH DIRECT MARKETING (OBJECTION PURSUANT TO ARTICLE 21(2) OF THE GDPR).

Right to complain to the competent supervisory authority

In the event of violations of the GDPR, data subjects have the right to file a complaint with a supervisory authority, in particular in the Member State of their habitual residence, place of work, or the place of the alleged violation. This right to file a complaint is without prejudice to any other administrative or judicial remedies.

The Bavarian State Office for Data Protection Supervision (BayLDA) is responsible for this matter. You can contact the authority at: Promenade 18, 91522 Ansbach; Telephone: 0981 180093-0; E-Mail: poststelle@lda.bayern.de; Internet: https://www.lda.bayern.de/. You can also use the online complaint form of the authority for complaints.

Right to data portability

You have the right to have data that we process automatically based on your consent or in fulfillment of a contract handed over to you or to a third party in a commonly used, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done insofar as it is technically feasible.

Information, correction and deletion

Within the framework of applicable legal regulations, you have the right at any time to obtain information free of charge about your stored personal data, their origin and recipients, and the purpose of data processing, and if applicable, the right to correct or delete this data. You can contact us at any time for this purpose and for any further questions regarding personal data.

Right to restrict processing

You have the right to request the restriction of the processing of your personal data. To exercise this right, you can contact us at any time. The right to restrict the processing exists in the following cases:

  • If you dispute the accuracy of the personal data we store about you, we usually need time to verify this. During this period, you have the right to request that the processing of your personal data be restricted.
  • If the processing of your personal data occurred unlawfully, you may request the restriction of data processing instead of the deletion.
  • If we no longer need your personal data, but you need it to exercise, defend or establish legal claims, you have the right to request the restriction of the processing of your personal data instead of deletion.
  • If you have filed a complaint under Article 21(1) GDPR, a balance must be struck between your interests and ours. As long as it is not yet clear whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, these data may only be processed – apart from their storage – with your consent or to establish, exercise or defend legal claims or to protect the rights of another natural or legal person or for reasons of an important public interest of the European Union or a Member State.

The website operator has a legitimate interest in storing necessary cookies for the technically error-free and optimized provision of its services. If consent has been requested for the storage of cookies and similar recognition technologies, the processing will take place exclusively on the basis of this consent (Art. 6(1)(a) GDPR and § 25(1) TDDDG); the consent can be revoked at any time.

You can set your browser to be informed about the setting of cookies and to allow cookies only in individual cases, to exclude the acceptance of cookies for certain cases or generally, and to automatically delete the cookies when you close the browser. When cookies are deactivated, the functionality of this website may be limited.

Request by email, phone or fax

If you contact us by email, phone or fax, your request, including all personal data derived from it (name, request), will be stored and processed by us for the purpose of processing your request. We will not disclose this data without your consent.

The processing of this data is carried out on the basis of Art. 6(1)(b) GDPR, provided that your request is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in effectively processing the requests submitted to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR), provided that it has been requested; the consent is revocable at any time.

The data you send to us via contact requests remains with us until you request us to delete it, revoke your consent to its storage, or the purpose for storing the data no longer applies (e.g., after your request has been processed). Google Analytics

This website uses features of the web analytics service Google Analytics. The provider is Google Ireland Limited („Google“), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics allows the website operator to analyze the behavior of website visitors. In this process, the website operator receives various usage data, such as page views, dwell time, operating systems used, and the user’s origin. This data is combined into a user ID and assigned to the respective device of the website visitor.

Furthermore, with Google Analytics, we can record your mouse movements and scrolling and clicks, among other things. Furthermore, Google Analytics uses various modeling approaches to supplement the data collected and employs machine learning technologies in its data analysis.

Google Analytics uses technologies that enable the recognition of the user for the purpose of analyzing user behavior (e.g., cookies or device fingerprinting). The information collected by Google about the use of this website is usually transmitted to a Google server in the United States and stored there.

The use of this service is based on your consent pursuant to Art. 6(1)(a) GDPR and § 25(1) TDDDG. The consent can be revoked at any time.

The data transfer to the USA is based on the standard contractual clauses of the European Commission. Details can be found here: https://business.safety.google/adscontrollerterms/sccs/.

Only in exceptional cases is the full IP address transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide other services related to website activity and internet usage to the website operator. The IP address submitted by your browser as part of Google Analytics will not be merged with other data from Google.

If you have a Google account, the visitor data from Google Analytics is linked to your Google account and used for personalized advertising messages. The data is also used to create anonymized statistics on the user behavior of our users.

Demographic characteristics in Google Analytics

This website uses the „demographic features“ function of Google Analytics to display relevant advertisements within the Google advertising network to website visitors. This allows reports to be created that contain information about the age, gender, and interests of the page visitors. This data comes from interest-based advertising by Google as well as from visitor data from third-party providers. This data cannot be associated with any specific person. You can disable this function at any time via the display settings in your Google account or generally prohibit the collection of your data by Google Analytics as described in the „Objection to Data Collection“ section.

This involves collecting information such as the orders placed, average order values, shipping costs, and the time from when a product is viewed to when a purchase is made. This data can be aggregated by Google under a transaction ID that is associated with the respective user or their device.

Google Ads

The website operator uses Google Ads. Google Ads is an online advertising program of Google Ireland Limited („Google“), Gordon House, Barrow Street, Dublin 4, Ireland.

Furthermore, targeted advertisements can be displayed based on the user data available at Google (e.g., location data and interests) (demographic targeting). As a website operator, we can quantitatively evaluate this data by, for example, analyzing which search terms led to the display of our advertisements and how many ads resulted in corresponding clicks.

Vimeo

We embed videos from Vimeo on our website. The provider is Vimeo.com, Inc., 330 West 34th Street, 5th Floor, New York, NY 10001, USA („Vimeo“).

Type of processed data and purpose: When loading and playing a video, your IP address, the date and time of the access, the page accessed, browser and device information, the referring URL, information about video views and interactions, as well as cookies and other identifiers are transmitted to Vimeo. We use the videos to provide information in a clear and concise manner. Vimeo processes data in particular to provide and secure the player, to store settings and, if applicable, for usage analysis.

Legal basis: Our legitimate interest in presenting our content in a clear and concise manner is Art. 6(1)(f) GDPR. As long as we obtain consent from Borlabs via the Vimeo player before loading it, the processing of personal data during this process is governed by Art. 6(1)(a) GDPR. The storage and reading of information on your device takes place based on your consent pursuant to § 25(1) TDDDG. You can revoke the consent at any time via the cookie settings with effect for the future.

Storage duration and transfer to third countries: We do not store the data transmitted to Vimeo via the Vimeo player ourselves. The storage duration at Vimeo depends on the data type and the processing purpose. According to Vimeo, the „player“ cookie can be stored for settings for one year and the „vuid“ analysis cookie for two years; other cookies may have shorter durations. A transfer to the USA cannot be ruled out. Further information can be found at https://vimeo.com/privacy and https://help.vimeo.com/hc/en-us/articles/26080940921361-Vimeo-Player-Cookies.

Wordfence

We have integrated Wordfence on this website. The provider is Defiant Inc., Defiant, Inc., 800 5th Ave Ste 4100, Seattle, WA 98104, USA (hereinafter „Wordfence“).

Wordfence serves to protect our website from unwanted access or malicious cyberattacks. For this purpose, our website establishes a permanent connection to the servers of Wordfence so that Wordfence can compare its databases with the accesses made to our website and, if necessary, block them.

The use of Wordfence is based on Art. 6(1)(f) GDPR. The website operator has a legitimate interest in protecting its website as effectively as possible against cyberattacks. If appropriate consent has been requested, processing takes place exclusively on the basis of Art. 6(1)(a) GDPR and § 25(1) TDDDG, insofar as the consent includes the storage of cookies or access to information on the user’s end device (e.g., device fingerprinting) within the meaning of the TDDDG. Consent can be revoked at any time.

The data transfer to the USA is based on the standard contractual clauses of the European Commission. Details can be found here: https://www.wordfence.com/help/general-data-protection-regulation/.

Our own services

Handling applicant data

We offer you the opportunity to apply to us (e.g. by email, post or via the online application form). In the following, we inform you about the scope, purpose and use of the personal data collected as part of the application process. We assure you that the collection, processing and use of your data is carried out in accordance with applicable data protection law and all other legal regulations, and that your data will be treated strictly confidentially.

Scope and purpose of data collection

When you submit an application to us, we process the personal data related to it (e.g., contact and communication data, application documents, notes during job interviews, etc.), insofar as this is necessary for deciding on the conclusion of an employment relationship. The legal basis for this is § 26 BDSG under German law (initiation of an employment relationship), Art. 6(1)(b) GDPR (general contract initiation), and – if you have given your consent – Art. 6(1)(a) GDPR. Your consent is revocable at any time. Your personal data will only be disclosed to persons involved in processing your application within our company.

If the application is successful, the data submitted by you will be stored in our data processing systems based on § 26 BDSG and Art. 6(1)(b) GDPR for the purpose of implementing the employment relationship.

As part of the application process, we may also conduct an internet search of your personal information. This includes, in particular, Google searches, LinkedIn and Xing. The legal basis for this type of processing is our legitimate interest in obtaining an overall impression of publicly accessible information about you in accordance with Article 6(1)(f) GDPR.

Duration of data retention

If we are unable to offer you a position, refuse to accept an offer of employment, or withdraw your application, we reserve the right to store the data you have provided with us for up to 6 months after the end of the application process (rejection or withdrawal of the application), based on our legitimate interests (Article 6(1)(f) GDPR). After that, the data will be deleted and the physical application documents destroyed. The storage serves, in particular, for evidentiary purposes in the event of a legal dispute. If it is evident that the data will be required after the 6-month period has expired (e.g., due to a pending or ongoing legal dispute), the deletion will only take place when the purpose for further storage no longer applies.

Longer storage may also take place if you have given your consent (Article 6(1)(a) GDPR) or if statutory retention obligations preclude deletion.
